Meaning of the constitution of India

1. What a Constitution Is

Constitution = supreme fundamental law of a country that lays down framework of governance — how the state is organized, how power is divided and exercised, and how rights of citizens are protected. It is written (document) or unwritten (conventions), but India's is written.

For India: Constitution of India = the longest written constitution (originally 395 Articles, 8 Schedules, now 448 Articles, 12 Schedules) that came into force 26 January 1950, adopted 26 November 1949 by Constituent Assembly.

2. Why a Constitution Is Needed

  • Legitimacy: source of authority (people's will — "We, the People...").
  • Organization: defines organs of state — Legislature, Executive, Judiciary and their powers.
  • Limit on power: prevents arbitrary rule, ensures rule of law.
  • Rights and duties: enumerates Fundamental Rights (Part III) and Duties (Part IVA), Directive Principles (Part IV).
  • Federalism + unity: balances Centre-State powers while preserving integrity.

3. Defining Features of "Meaning" (exam points)

  • Supreme law: all other laws must conform to it; judicial review (SC/HC can strike down unconstitutional laws).
  • Fundamental: not easily changeable; amendment procedure (Article 368) is special.
  • Social contract: people's consent via Constituent Assembly (indirectly representative).

4. India-Specific Meaning

  • Adopted by Constituent Assembly chaired Dr. B.R. Ambedkar (Drafting Committee Chairman), Dr. Rajendra Prasad (President), B.N. Rau (Constitutional Advisor).
