3. Significance (exam five points)
- Source of authority: "We, the People..." ⇒ people are sovereign (Kelsen's Grundnorm).
- Objectives and philosophy: declares nature of state (sovereign etc.) and goals (justice etc.) — guides interpretation (SC uses Preamble as aid to understand ambiguous provisions; Berubari 1960 said Preamble not amendable? Later Kesavananda says it is part of Constitution and amendable under Art 368, but basic structure cannot be destroyed).
- Reflects Objectives Resolution (Nehru) → Preamble.
- Not justiciable (not enforceable via writ alone) but fundamental to constitutional interpretation; SC in Kesavananda Bharati (1973) held Preamble is part of Constitution.
- Amendability: 42nd added Socialist, Secular, Integrity.
4. Worked Question
Q: Is Preamble part of Constitution? Berubari (1960) no, Kesavananda (1973) yes — now settled: yes, amendable but basic structure intact.
5. Exam Points
- Quote Preamble (with Socialist, Secular added) — 5 marks, very frequent (often ask to write).
- Explain each keyword (sovereign, secular etc.) — 7-10 marks, very frequent (the most common Preamble question).
- Significance and whether amendable (42nd + Kesavananda) — 5-7 marks, very frequent.
- Distinguish from USA Preamble — 3 marks.
